By accessing, browsing, or using SRTGen.com ("the Service", "Platform", "we", "us", or "our"), you confirm that you are at least 13 years of age (or 16 years of age in the European Union, United Kingdom, and other applicable jurisdictions), have read and understood these Terms of Service ("Terms"), and agree to be legally bound by them.

If you are accessing the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" and "your" refers to that entity.

If you do not agree to these Terms, you must immediately stop using the Service.

We reserve the right to update or modify these Terms at any time. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. We will notify registered users of material changes via email or a prominent notice on the Platform.

SRTGen.com is an AI-powered subtitle and caption automation platform that provides the following services:

Core Features: - AI Speech-to-Text Transcription: Convert spoken audio from video files into synchronized subtitle text in 50+ languages with up to 99% accuracy. - AI Translation: Translate generated subtitles into multiple languages simultaneously. - Subtitle Burning (Cloud Render): Permanently embed captions directly into video files via our cloud rendering infrastructure. - Professional Subtitle Editor: A browser-based editor for customizing subtitle styling, timing, animations, fonts, colors, and layouts. - Link-Based Import: Extract video content directly from TikTok, Instagram Reels, and YouTube Shorts by pasting a URL, without requiring a local file download. - Subtitle Export: Export subtitles in SRT, VTT, ASS, and TXT formats. - Social Automation (@SRTGenBot on X): Connect your X account and tag @SRTGenBot under any video on X (formerly Twitter) to automatically generate and receive subtitled video replies. - Developer API: Programmatic access to transcription, translation, and burning services via REST API (available on Pro and Business plans). - Cloud Storage: Secure, managed cloud storage for uploaded videos, audio, and processed project files.

Credit System: The Service operates on a credit-based consumption model. Credits are deducted based on the duration of the media processed: - AI Transcription: 1 credit per 1 minute of audio - AI Translation: 1 credit per 2 minutes - Cloud Burn: 1 credit per 4 minutes

Credits are allocated via subscription plans (renewed monthly or annually) and optional one-time Credit Pack top-ups. Top-up credits do not expire. Subscription-period credits expire at the end of each billing cycle.

Account Creation: You must create an account to access most features. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

Account Security: You are responsible for safeguarding your password and any credentials (including API keys) associated with your account. You agree to notify us immediately via our Contact Us page of any unauthorized use of your account. We are not liable for any loss or damage arising from unauthorized access resulting from your failure to maintain account security.

Account Termination by You: You may request account termination at any time by sending a request via our Contact Us page. Upon closure, your data will be deleted in accordance with our Privacy Policy. Unused subscription credits are non-refundable unless otherwise required by law.

Account Suspension by Us: We reserve the right to suspend or terminate your account immediately, without prior notice, if we determine that you have: - Violated these Terms - Engaged in fraudulent activity - Abused the credit or quota systems - Uploaded content that violates applicable laws or our Content Policy

One Account Per Person: You may not maintain multiple accounts. Accounts found to be created to circumvent subscription limits or bans are subject to immediate termination.

Subscription Plans: We offer the following tiers (subject to change with notice): - Free: 30 signup credits, limited monthly usage, 200MB cloud storage, 3 X Bot requests/month. - Starter ($9/month or $54/year): 240 credits/month, 10GB storage, 20 X Bot requests/month. - Pro ($29/month or $174/year): 1,000 credits/month, 50GB storage, 100 X Bot requests/month, Developer API access. - Business ($89/month or $534/year): 8,000 credits/month, 250GB storage, 500 X Bot requests/month, Developer API access.

Yearly plans are billed annually and offer approximately 50% savings compared to monthly billing.

Payment Processing: All payments are processed securely via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the selected billing interval. Prices are in USD and exclusive of applicable taxes.

Upgrades & Downgrades: You may upgrade or downgrade your subscription at any time. Upgrades take effect immediately; downgrades take effect at the start of the next billing period. Unused credits from a downgraded plan are not transferred.

Credit Top-Ups: You may purchase additional credits at any time. Top-up credits are non-expiring and are consumed after your subscription-period credits. Top-up packages are available from $3 for 30 credits up to $75 for 1,000 credits.

Cancellations: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then. We do not provide prorated refunds for unused time within an active billing period.

Refunds: - All purchases are generally non-refundable. We do not provide refunds except in exceptional circumstances. - We reserve the right to issue refunds or account credits at our sole discretion in cases of documented service outages or billing errors. - To request an exception, contact us via our Contact Us page.

Pricing Changes: We reserve the right to change subscription pricing. If we change the price of your current plan, we will provide at least 30 days' notice via email. Your continued use of the subscription after that period constitutes acceptance of the new price.

Permitted Use: You may use the Service for lawful personal, commercial, or organizational purposes, including transcribing, captioning, and translating video content that you own or have the right to process.

Prohibited Activities: You agree NOT to use the Service to process, generate, transcribe, or distribute content that: - Is illegal under applicable local, national, or international law - Contains adult content, explicit sexual material, pornography, or sexually explicit acts - Infringes any copyright, trademark, patent, trade secret, or other intellectual property right - Is defamatory, harassing, hateful, or incites violence or discrimination - Contains child sexual abuse material (CSAM) or exploitative content involving minors - Constitutes spam, unsolicited advertising, or mass automated messaging - Is designed to deceive, defraud, or manipulate individuals (e.g., deepfakes for fraud) - Violates any third-party's privacy or data protection rights

API & Automation Restrictions: - API usage is rate-limited based on your plan. Excessive usage that degrades the Service for other users is prohibited. - You may not use the Developer API to build a competing subtitle generation service or resell API access. - Automated scripts or bots that circumvent usage limits or abuse the @SRTGenBot feature are strictly prohibited.

X Bot (@SRTGenBot) Rules: - The @SRTGenBot feature may only be used by registered SRTGen.com users who have connected their X accounts. - Monthly X Bot request quotas are enforced per plan. Attempts to exploit or bypass these quotas will result in account suspension. - You are responsible for ensuring that the videos you process via @SRTGenBot do not infringe on the rights of third parties.

Consequences of Violation: Violations of this Acceptable Use Policy may result in immediate account suspension, termination without refund, and/or legal action.

Your Content: You retain all ownership and intellectual property rights to the media files, videos, and content you upload to or process through the Service ("User Content"). By uploading content, you grant SRTGen.com a limited, non-exclusive, royalty-free license to store, process, transform, and transmit your content solely for the purpose of providing the Service to you.

Our Content: All software, algorithms, AI models, UI designs, branding, logos, documentation, and other materials constituting the SRTGen.com platform are the exclusive property of SRTGen.com and its licensors. These Terms do not grant you any right to use our trademarks, logos, or other proprietary materials without our prior written consent.

Subtitle Output: The subtitles, transcriptions, translations, and burned videos generated from your content are owned by you. We do not claim rights over your generated output.

DMCA / Copyright Complaints: If you believe that content on the platform infringes your copyright, please send a notice via our Contact Us page with the following information: a description of the copyrighted work, the URL of the allegedly infringing content, your contact information, and a statement of good faith belief that the use is not authorized. We will respond to valid takedown notices in accordance with the Digital Millennium Copyright Act (DMCA).

Third-Party Content: When using the link-import feature, you represent that you have the rights or permission to process the imported video for your intended use. We are not responsible for rights clearances on content you import from third-party platforms.

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms.

Key data practices include: - We store uploaded video and audio files in Backblaze B2 cloud storage using secure, encrypted connections. - AI processing is performed using Google Gemini and AssemblyAI APIs. Audio content may be transmitted to these services for processing. Please review their respective privacy policies. - Payment processing is handled by Stripe, Inc. We do not store your full credit card number. - Your X account credentials (access tokens) are stored securely and are used only to enable the @SRTGenBot automation feature. - You may request deletion of your account and associated data at any time.

By using the Service, you acknowledge and consent to the data practices described in our Privacy Policy.

Availability: We strive for 99.9% uptime but do not guarantee uninterrupted access to the Service. We may perform scheduled or emergency maintenance that causes temporary unavailability. We will attempt to provide advance notice for planned maintenance.

No Warranty: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING (WITHOUT LIMITATION): - Warranties of merchantability, fitness for a particular purpose, and non-infringement. - Warranties that the Service will meet your requirements or expectations. - Warranties regarding the accuracy, completeness, or timeliness of AI transcription or translation outputs. - Warranties that the Service will be error-free or that defects will be corrected.

AI Output Disclaimer: AI-generated transcriptions and translations are algorithmic outputs and may contain inaccuracies. You are responsible for reviewing and validating all AI-generated content before use in any professional, legal, medical, or high-stakes context. SRTGen.com is not liable for losses resulting from reliance on AI-generated content without human review.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SRTGEN.COM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, LICENSORS, AND AGENTS SHALL NOT BE LIABLE FOR:

- Any indirect, incidental, special, consequential, or punitive damages. - Any loss of profits, revenue, data, goodwill, or business opportunities. - Any damages resulting from your inability to access the Service or from unauthorized access to your account. - Any damages resulting from third-party service providers (including AI processing services, cloud storage, or payment processors).

IN ALL CASES, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) USD $50.00.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential damages, so some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless SRTGen.com, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses (including reasonable attorneys' fees) arising out of or relating to:

- Your violation of these Terms - Your User Content or the processing thereof - Your use of the Service in violation of applicable law - Your infringement of any intellectual property or privacy rights of any third party - Any claims by third parties arising from content you subtitle, translate, or distribute using our platform

By You: You may request termination of your account and use of the Service at any time by submitting a request via our Contact Us page. Credit balances and subscription periods are non-refundable upon voluntary termination, except as described in Section 4.

By Us: We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Reasons for termination include, but are not limited to, violations of these Terms, non-payment, fraudulent activity, or if we discontinue the Service.

Effect of Termination: Upon termination: - Your access to the Service will cease immediately. - All of your stored content may be deleted in accordance with our data retention schedule. - Any outstanding payment obligations survive termination. - Sections of these Terms that by their nature should survive (including intellectual property, disclaimers, indemnification, and limitation of liability) shall survive.

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where SRTGen.com is registered, without regard to its conflict of law provisions.

Informal Resolution: Before filing any formal legal claim, you agree to first reach out via our Contact Us page and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days.

Arbitration: If we cannot resolve a dispute informally, any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved by binding arbitration, except where prohibited by local law. The arbitration shall be conducted on an individual basis; class action arbitrations are waived.

Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent unauthorized use of intellectual property or to protect confidential information.

Entire Agreement: These Terms (together with our Privacy Policy and any other policies referenced herein) constitute the entire agreement between you and SRTGen.com regarding the Service and supersede all prior agreements.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign our rights and obligations.

Force Majeure: We shall not be liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, government actions, pandemics, or internet infrastructure failures.

API Terms: Usage of the SRTGen.com Developer API is subject to these Terms and any additional API-specific documentation published on our developer portal.

Language: These Terms are written in English. To the extent any translated version conflicts with the English version, the English version shall control.
